Rana Plaza collapse: Only 9 years of plaintiff testimony in murder case

The trial of the case started three months ago after the High Court stayed the stay order.

On April 11, the testimony of Wali Ashraf, Deputy Inspector of the Criminal Investigation Department, the plaintiff in the case, ended at the District and Sessions Judge’s Court in Dhaka.

Prosecution witnesses Ikramul Haque, Shiuli Akhter and five others have been summoned to testify in court on May 29.

Additional counsel Bimal Samaddar is handling the case on behalf of the state. Lawyer Farooq Ahmed is fighting as the main lawyer for the accused.

The case is being heard by Dhaka District and Sessions Judge AHM Habibur Rahman Bhuiyan.
Wali Ashraf, the plaintiff in the case, appeared in the court on January 31 and started testifying. The judge then directed the jail authorities to show cause for not bringing the main accused Sohail Rana from the jail to the court for testimony on the second day.

Prosecutor Bimal Samaddar told bdnews24.com that although the plaintiff had appeared in court that day, the judge could not take evidence as Sohail Rana failed to appear.

Accused Jannatul Ferdous, Anisur Rahman alias Anisuzzaman, Jamshedur Rahman, Yusuf Ali, Uttam Kumar Roy, Nayan Mia, Belayet Hossain, Aminul Islam, Abdus Salam, Bidyut, Madhu, Rakibul Hasan Russell, Rafiqul Islam, Mahmudur Rahman Tapas were present on bail during the trial. Awlad Hossain Morzina Begum, Sarwar Kamal, Anil Das are facing trial after appearing in court.

Runner’s father is the accused in this case. Abdul Khaleq alias Khaleq Kullu and Ataur Rahman died. No papers were found from the High Court regarding the suspension order of accused Savat’s former mayor Refat Ullah.

Accused Mahbubur Rahman, Farzana Islam, Md. Shafiqur Islam Bhuiyan, Menowar Hossain Biplob, Syed Shafiqul Islam Johnny, Rezaul Islam, Rezaul Islam, Nantu Contractor, Abu Bakar Siddique, Md. Abul Hasan, Mohammad Ali Khan and Bazlul Samad are on the run.

So far, out of 39 accused, only two of them have been suspended due to the stay order of the High Court.

The date of commencement of testimony before January 31 has been postponed more than 25 times.

Prosecutor Anwarul Kabir Babul said no evidence was being taken in the case filed under the Building Construction Act after the Rana Plaza collapse.

As seen in the documents, the officer in charge of RAJUK said. In the case filed by Helal Uddin, on April 26, 2015, CID Assistant Superintendent of Police Vijayakrishna filed a chargesheet against 16 people, including Sohail Rana, owner of Kar Bhaban. The allegations were made about three years ago.

Prosecutor Anwarul Kabir Babul Gayle said at the end of January that some of the accused had filed a revision petition challenging the validity of the charges. Among them, the court rejected the revision application of Bazlus Samad, managing director of New Web Bottoms Limited and Mahbubur Rahman, a former assistant engineer. On the other hand, the chairman of Phantom Apparels Limited Muhammad Aminul Islam was granted revision and he was released. If the matter of revision is settled, the testimony of this case can be started.

So far, only the plaintiff has testified in the murder case filed in connection with the Rana Plaza collapse in Savar.

Runner was sentenced to three years in prison for failing to file an asset. He was also fined Rs 50,000.

Judge KM Imrul Kayes of Dhaka Special Judge’s Court-8 gave the verdict on August 29, 2016.

The court also sentenced Runner’s mother Morzina Begum to six years in prison on a charge of acquiring known non-income assets and giving false information. In addition to imprisonment, the judge confiscated 7 crore 8 lakh 8 thousand 990 rupees from his assets.

Two cases were registered in Savar police station on the same day that shook the world. The following year, the Anti-Corruption Commission filed another case.

In the first case, SI Wali Ashraf of Savar Model Police Station filed a case against the building and factory owners citing casualties.

On April 26, 2015, two years after the case was filed on charges of ‘negligence and negligent murder’, CID’s Assistant Superintendent of Police Vijayakrishna filed a chargesheet against 41 people, including Kar Bhavan owner Sohail Rana. 594 people were called as witnesses in the case.

On July 18, 2016, Dhaka District and Sessions Judge SM Quddus Zaman framed charges against the accused and ordered the trial to begin.
